Mais sa mise en \u0153uvre se heurte souvent \u00e0 des m\u00e9canismes de privatisation des rives. Cet article mobilise la g\u00e9ographie du droit et la figure du \u00ab\u00a0d\u00e9tective g\u00e9o-l\u00e9gal\u00a0\u00bb pour mettre l\u2019accent sur les pratiques qui se sont d\u00e9velopp\u00e9es en Suisse le long des rives du L\u00e9man pour r\u00e9aliser un chemin public. Il aborde ainsi d\u2019une mani\u00e8re indirecte les relations de pouvoir entre d\u00e9fenseurs de cet int\u00e9r\u00eat public et propri\u00e9taires priv\u00e9s. \u00c0 partir d\u2019observations de terrain et de confrontation avec le cadastre, les bases l\u00e9gales et la jurisprudence, un \u00ab\u00a0travail d\u2019enqu\u00eate\u00a0\u00bb est men\u00e9. Il permet de mettre en \u00e9vidence, gr\u00e2ce \u00e0 de nombreux allers-retours entre droit et territoire, un d\u00e9calage significatif entre les logiques issues de la norme juridique et celles de sa mise en \u0153uvre. Ce d\u00e9calage est li\u00e9 aux pratiques que les agents publics d\u00e9veloppent au travers des nombreuses interactions qu\u2019ils entretiennent avec les propri\u00e9taires riverains, les autorit\u00e9s politiques, les acteurs favorables \u00e0 l\u2019acc\u00e8s public aux rives, la jurisprudence, les lois et le territoire, dans un contexte o\u00f9 la temporalit\u00e9 joue un r\u00f4le important. Ces diff\u00e9rentes investigations sont men\u00e9es dans le but <em>in fine<\/em> de rep\u00e9rer des pistes d\u2019am\u00e9lioration potentielle de l\u2019action publique d\u00e9di\u00e9e \u00e0 l\u2019acc\u00e8s aux rives.<\/p><p>Ensuring public access to the shoreline is a recognized public interest. However, its implementation is often hampered by shoreline privatization mechanisms. This paper mobilizes legal geography and the figure of the \u201cgeo-legal detective\u201d to focus on the practices that have developed in Switzerland along the shores of Lake Geneva to complete a public walkway. It thus addresses the power relationship between promoters of this public interest and private owners in an indirect way. Based on field observations and confrontation with the land registry, laws and case law, a thorough investigation is carried out. By means of iterations between the legal and the territorial conditions, the paper discusses a significant gap between the legal norm and its implementation. This gap is linked to the practices that public officials develop through the interactions they maintain with shoreline landowners, public authorities, actors promoting public access to shorelines, legal experts, laws and space, in a context where temporality plays a significant role. The ultimate aim of this paper is to identify potential avenues for improving public action dedicated to shoreline access.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Ruegg, J.
